1. The site www.vinylgourmet.com is property of Sergio Redondo, Lda with NIPC/VAT PT510851851 and headquarters located at Rua Padre Cruz, nr 1 - 3º Dto, Pedernais, 2620-539 Ramada, Portugal.
2. All contents of the site www.vinylgourmet.com (ilustrations, texts, titles, brands, images, videos) have reserved rights and are the property of Sergio Redondo, Lda. Reproduction of such contents, as a whole or in part, through any procedure and on any support, is subject to previous written consent. All information, contents and documents offered by our services are protected by current legislation regarding its intelectual property and copyright.
Prices and Stock availability
1. Prices and products information are subject to change without notice.
2. All prices are inclusive of any taxes required by law when and if applicable in agreement with current legislation.
3. In case of publication errors or translation mistakes regarding prices and products descriptions, or if the price shown is incorrect or much lower than expected by mistake, regardless of what caused the mistake (it could be a software bug, manual error, technical issue, etc) Vinyl Gourmet reseves the right to cancel any orders even the ones that have already been confirmed as well as providing a full refund for any such orders that have already been paid for.
4. Vinyl Gourmet cannot be responsible in any way for products being Out of Stock that might cause failure to completely or partialy fulfill any orders, or any delays it might cause. In such cases where it is impossible to completely fulfill an order, if payments were received a refund will be issued.
5. The prices do not include shipping costs, they are calculated and presented during checkout. For international orders Vinyl Gourmet cannot be held responsible for any delays or taxes incurred or applied to import of goods at the destination country Customs service, these shall be supported and paid by the customer.
Product Information
1. The imagens and photos of any products in our store are for illustrative purposes and might not represent with 100% accuray the actual product, as such the photos are not integral part of the contractual agreement and do not constitute any compromise from Vinyl Gourmet.
2. Vinyl Gourmet is not responsible for the information in the technical specifications and product descriptions provided by our partners or suppliers and we can't guarantee its validity or accuracy.
Product returns and exchange
1. Returns will be accepted within 15 days from the date of the order if adequately justified.
2. Product returns will only be accepted in the same condition of the original sale, that is in the exact same condition as when they were ordered, sealed and without any changes to their original condition, without any anomalies or damage.
3. For any product return, for any reason, and before sending anything back to us, the customer must contact Vinyl Gourmet to obtain a return authorization. Any returns received without the customer previously contacting us will not be accepted or considered valid. If the authorized return has not been received after 30 days of the authorization date, the sale is considered closed and final.
4. Product exchange depends on stock availability and in most cases a refund will be issued.
5. Return shipping costs, for any reason, are the responsibility of the customer.
6. The return procedure is quite simple, it can be made by mail with expenses paid by the customer, or by leaving the products in our company office, but it does require previous contact with our services to ensure we know about your intention to withdrawal and can be prepared to assist you and follow your request.
7. If a return is accepted Vinyl Gourmet guarantees to make a refund to the customer within 30 days from the reception of the returned items according to current legislation.
Products Warranty
1. All products sold by Vinyl Gourmet are covered by warranty against product manufacturing defects, as long as they are detected and communicated to Vinyl Gourmet within the time frame defined by the Portuguese Warranty Law (EU). Due to the complex stock managment involved with this type of limited availability products, Vinyl Gourmet asks its customers to verify the condition of all vinyl records or other products bought from us to check for such defects and let us know within 15 days from the date of the order.
2. When there is proven manufacturing defect that could only be detected after unsealing the product, we will accept refund or exchange requests if the product is returned to us in the condition it was in when the defect was detected, within the time frame defined by the Portuguese Warranty Law (EU).
3. If an item is damaged in shipment, you must save all packaging and notify us immediately or within 1 day so that we can initiate a claim process with the carrier. We will inform you of what steps must be taken with your damaged item/package within 24 business hours after contacting us.
4. This warranty excludes any damage or defects resulting from incorrect product usage beyond the normal use or outside the technical specifications context for which they were conceived, as well as any damage that could have been avoided by selecting one of the special free packaging services provided by Vinyl Gourmet.
5. Inner sleeves of any type are excluded from warranty.
6. Return shipping costs, for any reason, are the responsibility of the customer.
Right of Withdrawal (cool off period) for distance sales
1. The Customer may exercise its right to terminate the contract and subsequent cancellation of an order placed at www.vinylgourmet.com within 14 days from the date of receipt of your order, without penalty and without giving any reason, in accordance with Decree Law No. 143/2001 of April 26, reprinted in Appendix by Decree-Law n. º 82/2008 of 20 May. The product must be returned in salable condition (ie can not be opened or used) within 14 days counted from the order reception, by contacting our Customer Support services or using the contacts we provide on our website in several visible and easy to access locations.

The return procedure is quite simple, it can be made by mail with expenses paid by the customer, or by leaving the products in our company office, but it does require previous contact with our services to ensure we know about your intention to withdrawal and can be prepared to assist you and follow your request.

4. All returned products must be in their original sale condition, that is in the exact same condition as when they were ordered, sealed and without any changes to their original condition, without any anomalies or damage.
5. The customer cannot use the right of withdrawal as defined by article 7 of in accordance with Decree Law No. 143/2001 of April 26, reprinted in Appendix by Decree-Law n. º 82/2008 of 20 May when the goods provided are audio recordings or discs from which the original protective sealing has been removed. All products are bought new and sealed (except for used records noted as such). All Vinyl Gourmet optional services such as Expert Packaging or Professional Record Cleaning, be them free or paid services, that are applied to the items selected during the checkout process, are considered as separate operations applied to the customer owned items after they have been ordered and paid by the customer.
Refund options and deduction of charges
1. These are the available options and ways a refund can be issued:
a) Voucher of the same value or more, valid for future orders made at www.vinylgourmet.com
b) Bank Wire transfer to the account of your choice (national or international as long as it belongs to a country that is part of the SEPA agreement)
c) If the original payment was made using a credit card through the available Payment Gateways, the refund will be issued using that same method directly to the credit card originally used.
2. For international orders, the customer will be financially responsible for any duties and taxes incurred to Vinyl Gourmet for the return shipment. These charges will be deducted from any credit or refund you were to receive.
Special UPDATE as of March 5, 2020:
Since March 5, 2020 PayPal unilaterally decided to stop refunding the merchant for payment fees when the merchant refunds a customer transaction. This means that the fees that are charged by PayPal when the customer sends a payment are permanent. Depending on the country from where the payment is made, these fees can range between 3% and 6% of the entire transaction value, including shipping costs. For this reason, after March 5, 2020 and for all orders paid via PayPal gateway, any refund provided by Vinyl Gourmet will be subtracted of the respective fees value that was charged by PayPal when the customer paid opting for PayPal payment, so that the refund value reflects the actual value that we received from the customer.
Vinyl Gourmet liability disclaimers & Private Consumer Market Positioning
1. Vinyl Gourmet cannot be held responsible for any delays or failure to comply with any contractual obligations caused by "force majeure" reasons, public disturbance, total or partial strikes, any reasons relating to the service provided by postal, transportation or communication companies, floods, fires or war.
2. Vinyl Gourmet cannot be held responsible for any damage, loss, or taxes incurred by any order placed for products shown on our website.
3. Vinyl Gourmet business, sales and services, using the online store and automated checkout system, are made available only to end consumers private market. By registering an acccount and using the store you declare to accept the prices, taxes, and order processing associated with the end consumer private market the store is designed for. Many of the order processing options, namely some or all of the accepted payment methods or discounts, are for exclusive use of end consumer private customers and cannot be used for any other purpose or type of customer. If you would like to order as a business customer or for professional market, with specific tax and order processing (such as tax exemption for EU VAT Registered businesses and specific payment options for B2B transactions, or specific shipping costs), this is possible but please contact us by phone or email so that we can create and manage your order accordingly.
Applicable law
1. These Terms & Conditions of sale and use are regulated by the Portuguese law and any European directives that have been adapted and applied to the Portuguese law, this is valid for any national or international orders.
2. All legal issues resulting from the interpretation or execution of this Terms & Conditions agreement can only be decided by the local Court of Law (Tribunal da Comarca) pertaining to the district of the Sergio Redondo, Lda headquarters in Portugal, and we hereby decline any other jurisdiction or court of law from any other location.

Information for UK customers - Imports after Brexit - Vat & Duty
We are delighted to continue to serve our many and loyal customers in the United Kingdom, thank you very much!
Since January 2021, after the UK left the European Union, all shipments from Portugal to the UK are considered imports.
Vinyl Gourmet does not charge or add any taxes on sales to the UK, these are VAT Free transactions. This means you might be charged VAT, taxes, fees and import duties, depending on the value of your order, when it arrives in the UK.
What does this mean and how does it affect delivery of my order? Please check list below:
1 - When placing an order at Vinyl Gourmet you must provide a phone contact.
Local authorities in the UK might need to contact you to process your order at customs. An email and phone information are mandatory to ensure they can reach you to collect information or taxes related to your shipment.
2 - You have to be reachable and responsive by phone and email if they try to contact you.
Local authorities in the UK might need to contact you to process your order, if they try to call, write or email you and they can't reach you, your package will be returned after a certain period of time (usually no more than 10 days).
3 - You have to be aware of shipment location to ensure you know if they try to contact you.
You are responsible for tracking the shipment at CTT Portugal website, and Royal Mail (for registered mail) or Parcel Force (for larger parcels) websites using their online tracking service once the package enters UK territory. You have to make sure you are aware of the package location and are responsible to confirm if Royal Mail or Parcel Force have tried to reach you by mail, phone or letter concerning any customs processing issues or duty/tax payments.
We've had cases where Royal Mail and Parcel Force tried to reach the buyer by mail or other means but couldn't get a response resulting the return of the package to the sender in Portugal. The customer is required to keep track of these procedures on the UK side, if they tried to reach you it will show on the tracking details, you'll have to contact them to learn what happened.
4 - You are responsible for the payment of taxes, fees, duty, if required by your local authorities.
Finally, the customer is responsible for the payment of any duty, taxes or fees associated with the import of goods into the UK.
We at Vinyl Gourmet cannot accept returned packages due to unclaimed customs object or unpaid duty/taxes/fees, it's not possible to issue a refund in such scenario. Failure to comply with any of these requirements 1, 2, 3 and 4 voids your right to a refund or valid return.
